There are many types of disputed probate cases. Probate disputes can arise in multiple contexts, most commonly during probates of wills, heirship determinations in the probate court, guardianship matters in the probate court, and disputed issues regarding trusts. Disputes can also arise regarding whether the executor or administrator of the estate or the trustee of the trust is properly conducting the financial affairs of the estate or trust. Further, disputes can arise regarding whether ownership to property is within the probate estate or whether it should pass outside of probate (and often to a different person than it would go to in the probate court).
